Microsoft has won one of its biggest victories in its fight against piracy in China after a Shanghai court ordered a local insurer to pay the US software company Rmb2.17m ($318,000) in damages.
微软(Microsoft)赢得了该公司在华打击盗版努力的最大胜利之一。此前上海一家法院命令,当地一家保险公司须赔偿微软经济损失217万元人民币(合31.8万美元)。
The court found Dazhong Insurance, a Shanghai-based insurer backed by Chinese state-owned and listed companies, guilty of infringing Microsoft's intellectual property by using illegal copies of its software.
法院认定,总部位于上海的大众保险(Dazhong Insurance)使用盗版微软软件的行为,侵犯了这家美国软件公司的知识产权。大众保险的股东为多家中国国有企业和上市公司。
“This is the first case in which Microsoft has taken a large Chinese company to court over copyright infringement of its software,” Microsoft said. “It is also the case in which Microsoft has been awarded the largest sum in damages in China so far.”
微软表示:“这是微软起诉中国大型企业侵犯其软件著作权的首起案件,也是迄今为止微软在华获赔金额最大的案件。”
In spite of increased Chinese efforts to root out piracy, foreigners complain the burden of collecting evidence rests with companies and that it has been difficult to get tough sentences for counterfeiters in court.
尽管中国加大了根除盗版的努力,但外国公司仍有所怨言,称它们必须承担举证责任,而且很难争取到法院对盗版者处以严判。
Yao Xin, China head of the Business Software Alliance, an international industry body, hailed the decision as a sign of Chinese authorities' determination to crack down on piracy.
国际行业机构——商业软件联盟(Business Software Alliance)中国区主管姚欣对判决表示赞许,称其表明了中国当局打击盗版的决心。
“[It is] also a warning bell for those large companies that still continue to use counterfeit software: using counterfeit software not only leads to legal consequences but also huge damage to the corporate image,” he said.
他说:“[本次判决]同时也为那些仍在使用盗版软件的大型企业敲响了警钟:使用盗版软件的行为不仅要受到法律制裁,并且会极大地损害企业形象。”
According to the Business Software Alliance, software makers incurred $6.67bn in losses caused by piracy in China in 2008. However, software piracy rates in China dropped by 10 per cent between 2004 and 2008.
根据商业软件联盟的数据,2008年,软件制造商因盗版问题在中国遭受了66.7亿美元损失。不过,在2004年至2008年间,中国的软件盗版率下降了10%。
Last August, four men in China were handed prison sentences and hefty fines for distributing counterfeit software over the internet.
去年8月,中国的四名男子因通过互联网分发盗版软件而被判有期徒刑和巨额罚款。
The men ran Tomato Garden, a website that generated advertising by offering pirated software for free.
这四名男子经营了一家名叫番茄花园的网站,靠提供免费盗版软件来获取广告收入。
